1. Acceptance of Terms

By accessing or using the Chawkr platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the platform.

2. Description of Services

Chawkr provides IP infrastructure profiling for proactive threat detection, allowing users to analyze, profile, and identify potential network threats through our proprietary algorithms and machine learning models.

3. Account Registration and Security

To use certain features of the platform, you need to create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Subscription and Payments

Chawkr offers various subscription plans with different features and limits. By subscribing, you agree to pay all fees specified for your selected plan. All payments are non-refundable except as expressly stated in these Terms or as required by applicable law. EU consumers may have a statutory right to withdraw from a subscription within 14 days of purchase, unless you have begun to use the service.

We may change our subscription fees at any time, but will provide advance notice before any change takes effect. Changes will not apply retroactively and will take effect on your next billing cycle.

5. Data Usage and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Chawkr, you consent to our data practices as described in our Privacy Policy.

Our use of cookies and similar technologies is also described in our Privacy Policy. By accepting these Terms, you acknowledge that we use cookies to improve our platform and your experience on it. You can manage your cookie preferences as described in the Privacy Policy.

6. User Obligations

You agree to use Chawkr only for lawful purposes and in accordance with these Terms. You will not:

• Use the platform to violate any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the platform or any other systems or networks
• Use the platform to harm, threaten, or harass any person or organization
• Use the platform for any illegal or unauthorized purpose
• Interfere with or disrupt the integrity or performance of the platform
• Use the platform if you are located in a country subject to EU, UK, or U.S. sanctions, or if you are listed on any applicable sanctions or restricted parties list.

You are solely responsible for the data you submit to the platform. You represent that you have the necessary rights and permissions to upload such data and that your use of the platform does not infringe or violate the rights of any third party. Any violations of TLP, PAP, FOUO, state secrets and any other restrictions are the responsibility of the user.

6A. Premium Content Usage and Sharing Restrictions

Premium posts, articles, reports, and other subscription-based content ("Premium Content") are provided exclusively for use within your subscribed team or organization. You agree to the following restrictions regarding Premium Content:

• Premium Content is strictly for internal use within your subscribed team or organization only
• You may not share, distribute, publish, or make available Premium Content to individuals outside your subscribed team or organization
• You may not post, republish, or redistribute Premium Content on public forums, social media, or any other public platforms
• You may not create derivative works based on Premium Content for external distribution
• Any unauthorized sharing or distribution of Premium Content constitutes a material breach of these Terms and may result in immediate termination of your subscription

These restrictions are designed to protect the proprietary nature of our threat intelligence content and ensure fair use within the scope of your subscription. Violation of these restrictions may result in legal action and immediate account termination.

7. Intellectual Property Rights

All content, features, and functionality of the Chawkr platform, including but not limited to text, graphics, logos, icons, images, algorithms, and software, are the exclusive property of Chawkr or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Chawkr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or your use of the platform.

In no event shall Chawkr's aggregate liability exceed the greater of €100 or the total fees paid by you to Chawkr in the 12 months preceding the claim.

8A. Service Availability & Disclaimers

We strive to ensure the platform is available at all times but do not guarantee uninterrupted or error-free service. The platform is provided "as is" and "as available."

9. Indemnification

You agree to indemnify, defend, and hold harmless Chawkr and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or relating to your use of the platform or violation of these Terms.

10. Term and Termination

These Terms shall remain in effect until terminated by either you or Chawkr. You may terminate these Terms at any time by cancelling your subscription and discontinuing use of the platform. Chawkr may terminate these Terms at any time for any reason without notice.

Upon termination, your right to use the platform will cease immediately. We may retain and use your submitted data as described in our Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the version information. Your continued use of the platform after such changes constitutes your acceptance of the modified Terms.

12. Force Majeure & Third-Party Service Dependencies

Chawkr shall not be liable or responsible for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, government actions, natural disasters, labor disputes, or internet outages.

Our platform relies on third-party service providers including Digital Ocean (infrastructure hosting), Stripe (payment processing), Auth0 (authentication services), and Shodan (data services). We expressly disclaim any responsibility for failures, errors, complications, service disruptions, outages, or shutdowns of these third-party providers. Any resulting platform unavailability, data processing delays, payment issues, or authentication problems caused by these external services are beyond our control and we shall not be held liable for any damages arising therefrom.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be resolved exclusively in the courts of Tallinn, Estonia.

15. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Chawkr with respect to the platform and supersede any prior agreements.
